Terms and Conditions of Sale

ARTICLE 1 - Scope

These General Terms and Conditions of Sale ("GTC") apply, without limitation or reservation, to all sales concluded by the Seller to non-professional buyers ("the Customers" or "the Customer") wishing to purchase the products offered for sale ("the Products") by the Seller on the website www.amaneclothing.com.

The Products offered for sale on the website are:

  • Women's clothing.

The essential characteristics of the Products, including specifications, illustrations, and dimensions, are presented on the website www.amaneclothing.com, which the Customer is required to read before placing an order.

The selection and purchase of a Product are the sole responsibility of the Customer.

Product offers are valid as long as they are visible on the website, subject to stock availability.

These GTC are accessible at any time on the website www.amaneclothing.com and shall prevail over any other document.

The Customer declares to have read and accepted these GTC by ticking the box provided for this purpose before proceeding with the online order.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

Products sold on www.amaneclothing.com are available for the following territories: Worldwide.

For orders shipped outside mainland France, the Customer is considered the importer of the Products.

For all Products shipped outside the European Union and French overseas territories, prices are automatically calculated excluding taxes.

Customs duties or other local taxes may apply and are the sole responsibility of the Customer.

ARTICLE 2 - Prices

Products are supplied at the prices in effect as listed on www.amaneclothing.com at the time the order is placed.

Prices are expressed in Euros, both excluding and including VAT.

Prices include any discounts granted by the Seller on www.amaneclothing.com.

These prices are firm and non-revisable during their period of validity but may be modified at any time outside of this validity period.

Prices do not include processing, shipping, transportation, and delivery costs, which are invoiced in addition and calculated before the order is placed.

The total amount payable by the Customer includes the product price and applicable fees.

An invoice will be issued by the Seller and provided to the Customer upon delivery.

ARTICLE 3 - Orders

The Customer must select the Products on www.amaneclothing.com according to the following process:

The Customer selects a Product to add to the cart, with the option to remove or modify it before confirming the order and accepting these GTC. The Customer will then enter their personal information or log into their account and choose the delivery method. After validating this information, the order will be considered final and will require payment by the Customer.

Product offers remain valid while visible on the website, subject to stock availability.

The sale is only considered valid after full payment of the price. The Customer must verify the accuracy of the order and report any errors immediately.

Any order placed on www.amaneclothing.com constitutes a distance contract between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an unresolved dispute regarding a previous order.

The Customer can track their order status on the website.

ARTICLE 3 Bis - Customer Account

To place an order, the Customer is invited to create an account (personal space).

To do so, the Customer must register by completing the form provided and agree to provide sincere and accurate information.

The Customer is responsible for updating this information. They can modify it by accessing their account.

To access their personal space and order history, the Customer must log in with their username and password, which are strictly personal. The Customer must not disclose them and is solely responsible for their use.

The Customer may request account deletion by contacting info@amaneclothing.com. This will be processed within a reasonable time.

In case of violation of the GTC, the Seller may suspend or terminate a Customer account after formal notice sent by email remains unanswered.

Any account deletion results in the permanent deletion of all Customer data.

In the event of a force majeure causing website or server malfunctions, the Seller cannot be held responsible.

Account creation implies acceptance of these GTC.

ARTICLE 4 - Payment Terms

The price is paid via secure payment:

  • Credit card payment.

The price must be paid in full on the day the order is placed.

Payment data is encrypted using the secure protocol provided by the authorized payment provider.

Payments are considered final only after the Seller receives full payment.

The Seller is not obliged to deliver the Products if the Customer has not fully paid the price as specified.

ARTICLE 5 - Delivery

Products ordered by the Customer will be delivered to France and the following countries: [Complete list as provided in the French version]

Deliveries occur within 5 to 6 business days to the address provided by the Customer.

Delivery means the transfer of physical possession of the Product to the Customer.

Unless otherwise stated, Products are delivered in a single shipment.

The Seller commits to making every effort to deliver within the specified time frame.

If Products are not delivered within 8 days after the estimated delivery date (excluding force majeure or Customer's fault), the sale may be canceled upon written request by the Customer.

Refunds will be made within fourteen days of contract termination.

Deliveries are made by an independent carrier to the address provided by the Customer.

If the Customer arranges their own carrier, the delivery is considered complete upon the Seller's handover of the Products to the carrier.

Special delivery or packaging requests from the Customer may result in additional fees.

The Customer must check the condition of the Products upon delivery and has 14 days to make claims, with supporting evidence (e.g., photos). Failing this, the Products are considered accepted.

The Seller will replace or refund defective or non-compliant Products promptly.

The transfer of risk occurs when the Customer physically takes possession of the Products unless the Customer chose their own carrier, in which case the risk transfers upon handover to the carrier.

ARTICLE 6 - Transfer of Ownership

Ownership of the Products transfers to the Customer only after full payment of the price.

ARTICLE 7 - Right of Withdrawal

The Customer has a withdrawal period of 14 days starting from receipt of the Products.

The right of withdrawal can be exercised using the withdrawal form provided or by sending an unambiguous request via email or postal mail.

Returns must be made in their original condition and packaging with all accessories and instructions, along with proof of purchase.

Damaged, used, or incomplete Products will not be accepted.

Return shipping costs are the responsibility of the Customer.

Exchanges (subject to availability) or refunds will be processed within 14 days of receipt of the returned Products.

ARTICLE 8 - Seller's Liability - Warranties

The Seller is liable for:

  • Legal conformity warranty.

  • Hidden defects warranty.

The Customer must inform the Seller of any defects or non-conformities in writing.

The Seller will refund, replace, or repair defective Products.

The Seller is not liable for:

  • Non-compliance with the laws of the delivery country.

  • Improper use or negligence by the Customer.

  • Normal wear and tear or accidents.

  • Non-contractual product images.

The Seller's liability is limited to replacing or refunding defective Products.

ARTICLE 9 - Personal Data

The Seller collects personal data for sales and delivery purposes.

Data collected:

  • When creating an account: Name, address, phone number, email.

  • For payment: Financial information.

Data recipients:

  • Transport providers.

  • Payment providers.

Data retention period: 5 years.

Customers have the right to access, rectify, delete, or object to their data by contacting info@amaneclothing.com.

ARTICLE 10 - Intellectual Property

The website content is the property of the Seller and its partners and is protected by intellectual property laws. Total or partial reproduction is strictly prohibited.

ARTICLE 11 - Applicable Law - Language

These GTC are governed by French law. The French version prevails in case of dispute.

ARTICLE 12 - Disputes

Unresolved disputes will be submitted to the competent courts under common law.
